Purpose and Scope
This Regulation P Privacy Disclosure describes how Premier Point Mortgage addresses the privacy of consumer financial information in connection with mortgage brokerage services. Regulation P, 12 CFR Part 1016, implements provisions of the Gramm-Leach-Bliley Act governing notices about privacy policies and practices and restrictions on certain disclosures of nonpublic personal information. This website disclosure is intended to provide additional transparency concerning our privacy practices. It is supplemental to, and does not replace, any formal privacy notice that Premier Point Mortgage is required to deliver to a consumer or customer under applicable law.
Who We Are
Premier Point Mortgage, NMLS #2184348, is a residential mortgage brokerage licensed to conduct mortgage brokerage activity in New Jersey and Florida, subject to applicable licensing, regulatory, lender, investor, and program requirements. References to “Premier Point Mortgage,” “we,” “us,” and “our” in this disclosure refer to Premier Point Mortgage as applicable to the consumer relationship.
What Is Nonpublic Personal Information
Nonpublic personal information generally includes personally identifiable financial information that a consumer provides to obtain a financial product or service, information resulting from a transaction involving a financial product or service, and information otherwise obtained in connection with providing a financial product or service, subject to the definitions and exclusions provided by applicable law.
Information We May Collect
In connection with an inquiry, prequalification, preapproval request, mortgage application, or mortgage transaction, we may collect information such as your name, address, telephone number, email address, Social Security number, date of birth, income, employment information, assets, account balances, debts, liabilities, credit history, credit scores, mortgage rates and payments, property information, transaction information, government-issued identification information, and other information reasonably necessary to evaluate, arrange, process, document, or facilitate a mortgage transaction. The specific information collected depends on the product, transaction, and stage of the mortgage process.
Sources of Information
Information may be obtained directly from you; from applications, forms, communications, documents, and website submissions; from consumer reporting agencies and other authorized data providers; from employers, financial institutions, settlement service providers, government or public records where permitted; and from lenders, investors, vendors, service providers, and other parties involved in processing or facilitating a mortgage transaction.
How Information May Be Used
We may use information to respond to inquiries; evaluate mortgage options; obtain credit or other authorized reports; verify identity, income, employment, assets, liabilities, property, and other application information; submit or process loan requests with wholesale lenders; communicate about an application or transaction; prevent fraud; satisfy recordkeeping, compliance, legal, and regulatory obligations; improve operations and services; and perform other activities permitted or required by law.
Sharing With Lenders and Transaction Participants
As a mortgage broker, Premier Point Mortgage may need to disclose information to wholesale lenders and other parties involved in arranging, processing, underwriting, closing, funding, servicing, or otherwise facilitating a requested mortgage transaction. Depending on the transaction, these parties may include lenders, credit reporting agencies, verification providers, appraisal or valuation providers, title or settlement providers, attorneys, insurance-related providers, technology providers, document providers, fraud-prevention providers, and other service providers. Any disclosure is subject to applicable law and the circumstances of the transaction.
Service Providers, Processing and Servicing Exceptions
Regulation P contains exceptions that may permit disclosure of nonpublic personal information without providing an opt-out right in specified circumstances, including disclosures necessary to effect, administer, or enforce a transaction requested or authorized by a consumer, and certain disclosures to service providers or in connection with joint marketing arrangements when applicable requirements are satisfied. Premier Point Mortgage may rely on applicable exceptions when legally appropriate. This disclosure does not expand our right to share information beyond what applicable law permits.
Sharing With Nonaffiliated Third Parties
Premier Point Mortgage does not use this website disclosure to claim a right to disclose nonpublic personal information to nonaffiliated third parties for purposes prohibited by law. Whether a particular disclosure is permitted, requires notice, requires an opportunity to opt out, or falls within a statutory or regulatory exception depends on the nature and purpose of the disclosure. Our formal privacy notice should be consulted for the specific categories of sharing applicable to our current practices.
Account Number Information
Applicable federal law restricts disclosure of account numbers or similar access codes for marketing purposes. Premier Point Mortgage will handle account-number information in accordance with applicable restrictions and will not use this disclosure as authorization for any practice prohibited by Regulation P or other applicable law.
Consumer Choice and Opt-Out Rights
Where Regulation P or another applicable law provides a consumer with a right to limit particular sharing, Premier Point Mortgage will provide the notices and reasonable means to exercise that right as required. Not every disclosure creates an opt-out right. For example, disclosures permitted under transaction-processing, servicing, legal, regulatory, or other applicable exceptions may not be subject to an opt-out requirement. Any formal opt-out instructions applicable to Premier Point Mortgage will be stated in the privacy notice provided for that purpose.
Initial, Annual and Revised Privacy Notices
Regulation P establishes requirements concerning initial privacy notices and, when applicable, annual and revised privacy notices. Premier Point Mortgage will provide notices as required by applicable law based on the nature of the consumer or customer relationship and our information-sharing practices. Federal law contains circumstances in which an institution may qualify for an exception from an annual notice requirement; qualification depends on the institution’s actual practices and applicable regulatory conditions.
Protection and Safeguarding of Information
Premier Point Mortgage seeks to protect personal and financial information through administrative, technical, and physical safeguards appropriate to the nature of the information and our operations. Access to nonpublic personal information should be limited to persons and service providers with a legitimate business, transaction, compliance, or legal need, subject to applicable requirements. No method of electronic transmission or storage can be guaranteed to be completely secure.
Former Customers
Privacy obligations do not necessarily end when a customer relationship ends. Premier Point Mortgage will handle nonpublic personal information concerning former customers in accordance with applicable privacy laws, our applicable privacy notice, record-retention requirements, and other legal obligations.
Fair Credit Reporting Act and Other Laws
Information-sharing practices may also be subject to the Fair Credit Reporting Act, state privacy laws, identity-theft requirements, information-security requirements, and other federal or state laws. Regulation P does not supersede protections provided by other applicable laws except as specifically provided by law. Where a state law provides greater consumer protection and is not preempted, additional requirements may apply.
New Jersey and Florida Consumers
Premier Point Mortgage conducts mortgage brokerage activity in New Jersey and Florida. Consumers in either state may have rights or protections under applicable federal and state laws in addition to those summarized here. Nothing in this disclosure is intended to waive or limit any right that cannot lawfully be waived or limited.
Website, Forms and Electronic Communications
Information submitted through this website, online forms, email, application portals, mortgage tools, or other electronic channels may become part of our business records and may be used in connection with the purpose for which it was submitted. Consumers should avoid sending sensitive financial information through unsecured channels when a secure application or document-upload method is available.
Relationship to Our Financial Privacy Notice
This page is an explanatory website disclosure. It is not intended to replace the formal privacy notice required by Regulation P. The CFPB provides a model privacy form that, when used consistently with its instructions, may satisfy specified Regulation P notice-content requirements. Premier Point Mortgage’s formal Financial Privacy Notice should accurately reflect our actual collection and sharing practices and should be reviewed whenever those practices materially change.
Changes to This Disclosure
We may revise this disclosure to reflect changes in law, regulation, guidance, technology, business practices, or our services. When required, changes to information-sharing practices will be communicated through a revised privacy notice or other legally required notice rather than solely through an update to this website page.
